Application of Terms of Use
The terms, conditions, and notices (the “Terms of Use” ) contained herein constitutes the customer (the “Customer”) agreement to all such terms, conditions, and notices. If the Customer does not agree with these terms and conditions then the Customer is not authorised to use this Website.

The Customer’s use of the Website and the information it contains (the “Content”) will be deemed as the Customer’s acceptance without modification of the Terms of Use and such shall constitute the entire agreement between the Customer and Nood Food with respect to the Website and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the Customer and Nood Food with respect to the Website.

Payment and Transactions and Policies
All transactions will be processed in Hong Kong Dollars (HKD)
All Products and services offered on the Website (the “Products”) must be paid for in advance. Cancellations must be made within our specified deadlines, otherwise the Customer may be charged the full amount.
In order to place orders with us, you must be aged 18 years of age or be in possession of a valid PayPal account [or be in possession of a valid credit/debit card issued by a licensed bank acceptable to Nood Food for payment, unless you have opted to pay in cash on delivery].
Most of the Products are available in select Nood Food locations (the “Nood Food Outlets”) while supplies last. In some cases, Products displayed for sale at the Website may not be available in the Nood Food Outlets. If the Customer wishes to purchase or to subscribe for any of these Products, the Customer will be asked by Nood Food or an authorised third party to supply certain information, including without limitation, the Customer's full name, address, telephone number and credit card information. The Customer agrees to provide Nood Food or such third party with the foregoing information as well as any other mandatory information that is accurate, complete and current, and to comply with the terms and conditions of any agreement that the Customer may enter into governing the Customer’s purchase of the Product. The Customer shall be responsible for all charges incurred through the Customer’s transaction as well as for paying any applicable taxes (if any).

Order Acceptance
Nood Food reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any Customer.
If Nood Food is refused authority from the Customer’s card issuer for payment, the Customer agrees to compensate Nood Food in full against any and all reasonable costs and expenses (including reasonably legal costs) that Nood Food may incur in obtaining payments due from the Customer.
Prices and availability of Products on the Website are subject to change without notice. Errors will be corrected when discovered, and Nood Food reserves the right to revoke any stated offer and to correct any errors, inaccuracies, or omissions (including after an order has been submitted).

Professional Advice and Information Disclaimer
The information provided here is for educational purposes only. Nood Food is in no way responsible for any decisions you may make resulting from the use of the Content or Products including, but in no way limited to, whether or not you choose to seek professional medical care or treatment. You hereby waive any claim you may have or acquire against Nood Food relating to your use of the Content.

Warnings
Nood Foods’s production kitchen handles nuts, legumes, and dairy. Although we are extremely careful with how we handle produce and the machines that are used for juicing and food preparation, cross contamination with nuts can occur. If the Customer is allergic to nuts then they must avoid the Products.
The Products have not been pasteurised and therefore, may contain harmful bacteria that can cause serious illness in children, the elderly and persons with weakened immune systems.
Do not consume the Products after their expiry date.
Do not consume Products if the packaging has been broken or tampered with in any way.
The Products are no way designed to substitute professional diagnosis or treatment in anyway. Customers’ medical doctors should always be regarded as the Customers’ primary source of information about diagnosis and possible treatments. Customers are strongly recommended that decisions regarding the diagnosis and treatment of any medical condition, including decisions regarding drug therapy, are complex medical decisions requiring the independent and informed judgment of your appropriate healthcare professional. In using the Website, the Customer is agreeing to be legally bound by these terms as modified from time to time ('Terms'). Before using the Website it is the Customer's responsibility to read Nood Food's Privacy Policy and to inform Nood Food if the Customer does not want us to collect information about the Customer, and reject any cookies.

Use of the Website
The Website is owned and operated by Nood Food.
Nood Food reserves the right to suspend or to terminate the Customer access to the Website at any time, with or without notice.

Rights
All intellectual property rights, including copyright, in the content displayed on the Website ('Content') belongs to Nood Food or its licensors.

Use of Content
The Website and the Content may only be used for the Customer’s personal, non-commercial use. For this purpose alone the Customer may retrieve and display the Content on a computer screen, except for this, the Customer agrees not to download, copy, reproduce, modify, store, archive, show in public, redistribute or commercially exploit in any way any part of the Content without the prior written permission of Nood Food. The Customer agrees not to use the Content nor the Website for any illegal or improper purpose, nor for any purpose which might infringe the rights of others or which might harass or cause inconvenience or distress to any person.
The Customer also agrees to abide by all copyright notices and restrictions attached to the Content and not to remove or alter any such notice or restriction or alter the Content in any way.

Limitation of liability and disclaimer
Nood Food obtains the Content from a wide range of sources and it includes facts, views, opinions and information likely to be of interest to users of the Website.
While all reasonable care is taken, we do not guarantee the accuracy, completeness, timeliness, performance or fitness for any particular purpose of the Website and the Content nor do we endorse or accept any responsibility for any views, advice, recommendations or opinions expressed on the Website or any website to which we link.
The Content should only be used for the Customer’s general information and use and not by way of specific recommendation or advice as the Customer’s circumstances are different to other users.

Before taking any action or decision based in whole or in part on the Content, the Customer should always make his or her own independent checks of any information that is important in making such decision or taking such action. The Customer should also seek professional advice in appropriate circumstances (such as medical advice.)
Nood Food does not give any warranties in respect of the Website or the Content, freedom from viruses or other contamination or that the Website is compatible with any computer systems, software and browsers.
All implied warranties or duties are excluded save if and to the extent that they may not lawfully be excluded.
Nood Food shall not be liable for any claims, losses, injuries, penalties, damages, costs or expenses arising from the Customer’s use of, or inability to use the Website or the Content or from any action taken, or omitted to be taken, as a result of using the Website or the Content.
To the fullest possible extent allowed by law, the Customer agrees that Nood Food will not be liable to the Customer and/or any other person for any consequential or incidental damages (including but not limited to loss of profits, loss of privacy or for failure to fulfil any duty) or for any other indirect, special or punitive damages whatsoever that arise out of or are related to the Customer’s use of the Website or the Content or to any breach of the terms by Nood Food.
The Customer agrees that the Customer’s exclusive remedy, shall be limited to the direct damages (if any) which the Customer actually incurs in reasonable and exclusive reliance on the Website or the Content, and for which we may be held liable by a competent court, of up to a limit of the refund of the amount the Customer paid (if any) in relation to the particular use of the Website or the Content in total during the month in which the damage first incurred.

Links
Nood Food contains links to other websites ("Third Party Websites") operated by parties who are wholly separate from Nood Food. Nood Food is not responsible in any way for the content, operation or availability of Third Party Websites, Nood Food will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Websites.

Competitions, prize draws and promotions
Nood Food may on occasion run competitions or prize draws either on its own behalf, for other parties or in conjunction with commercial partners. These will be subject to additional rules and conditions which will be made available at the time of any such competition.

Changes to these Terms
Nood Food reserves the right to make changes to any part of the Website and to add to or change the Terms of Use or the Privacy Policy. It is the Customer responsibility to refer to the Terms of Use whenever the Customer accesses the Website. Every time the Customer accesses the Website the Customer agrees to be bound by the Terms of Use and the Privacy Policy as varied or amended from time to time.

Indemnification
The Customer agree to indemnify and hold Nood Food and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable legal fees, due to or arising out of the Customer’s breach of the Terms of Use, or the Customer’s violation of any law or the rights of a third party. The Customer shall to the greatest extent allowed at law also indemnify and pay to Nood Food, as well as hold Nood Food harmless against any and all losses, claims, demands, liabilities, legal fees, or any other expense whatsoever which Nood Food may at any time sustain, incur, or be put to by reason of, or in connection with, its performance under this agreement, or the Customer’s use of the Website
